Why Donald Trump Wants the U.S. Supreme Court to Seal the Outcome of the Presidential Election

The Republican leader in the US Senate Mitch McConnell said President Donald Trump has an absolute right to investigate any “irregularities” in last week’s Presidential election.

Most likely outgoing US President Donald Trump refuses to admit that he was defeated in the recent election and is calling for the process to be taken to the US Supreme Court to decide whether he was actually defeated or not.

This is because by the time Democratic nominee Joe Biden had received about 240-245 electors, suddenly in the States of Pennsylvania and Michigan respectively Joe Biden received another 36 electors and won the election.

At the time, Republican nominee Donald Trump maintained a 14% lead in Pennsylvania state (≈500,000 votes) and Michigan State with an 11% (≈300,000) victory lead.

At this point, and in these States, he supports his view that the outcome of the elections is not unadulterated and does not admit defeat.

The order of the US Supreme Court on Friday 6/11/2020 to the Secretariat of the State of Pennsylvania was to separate the ballots received after 8pm on election day from the remaining ballots.

Essentially, the U.S. Supreme Court will decide whether to consider these “delayed” ballots, which were 70% in favor of Joe Biden and in some cities like Philadelphia by 99% in favor of Joe Biden.

Given the objections that current President Donald Trump’s lawyers will file for results in certain counties in Michigan, Wisconsin, Georgia, Nevada, Arizona and Pennsylvania respectively, it is the Supreme Court that will decide the credibility of those objections.

The U.S. Supreme Court will order the recount of ballots in counties in the upper states where Donald Trump is contesting their results.

The recount of votes will take place in full transparency before observers of both major parties. If irregularities are found on either the ballot papers or how they are counted, the Supreme Court will order a re-election in those states.

The candidate of the party that has the most votes in the state wins all the electors of that state. Even if his victory is one vote apart.

The only exception is the two states of Nebraska and Maine, which have a small number of electors.

The electors as a whole number 538 and whoever wins 270 (50%+1) wins the election. Each state has several electors equal to the sum of its representatives in Congress and the two senators each.

The result of the US Presidential election is judged by the number of electors and not by the number of votes cast.

The electors will meet on 6 January 2021 to choose the new US President. The President is sworn in on 20 January 2021 at 12 noon.

For the period of time pending the results of the six states mentioned above (Michigan, Wisconsin, Georgia, Nevada, Arizona and Pennsylvania) in the U.S. Supreme Court there is no motion for a resolution in the electors of those States and as a result no presidential candidate has the necessary number of electors.

The electoral system in the US has become a factor of political polarization since for purely demographic reasons Democrats have begun to lose presidential elections even when their Presidential candidate secures the most votes (see Democratic nominee Hillary Clinton’s 2016 presidential election).

Turnout in the recent presidential elections has reached record levels. It exceeded 66%, while in the corresponding elections of 2016 59% and 2012 57%. Democratic nominee Joe Biden received 3.5million more votes than Republican nominee Donald Trump.
